Wild Gems Collective is the public-facing brand. Huckleberry Gems LLC is the legal business entity operating under that assumed business name. Idaho's public business filing system distinguishes assumed business names from the underlying entity, which is why both names are identified here.

2 Scope of These Terms

These Terms apply to all current and future Wild Gems Collective offers, including but not limited to:

  • Websites and web pages
  • Sales pages, checkout pages, and forms
  • Digital products and downloads
  • Workshops, classes, and courses
  • Memberships and subscription offers
  • In-person and online events
  • Group experiences and private sessions
  • 9D Breathwork-related offers
  • Applications, waitlists, bookings, and registrations
  • Email, text, and customer support interactions tied to an offer

Additional terms may apply to certain offers, including separate policies for privacy, refunds, cancellations, waivers, or participation requirements. If there is a conflict between these Terms and a more specific written policy for a particular offer, the more specific policy will control for that offer.

3 Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to purchase most offers or enter into a binding agreement with us unless a specific offer clearly states otherwise and appropriate consent has been provided.

By using our website or purchasing an offer, you represent that:

  • The information you provide is true and accurate
  • You are legally able to enter into this agreement
  • You will use our website and services only for lawful purposes
  • You will not use our content, offers, or services in a way that violates these Terms
4 No Medical, Mental Health, or Emergency Services

Wild Gems Collective provides educational, experiential, creative, and wellness-related offerings. We do not provide medical care, psychiatric care, psychotherapy, diagnosis, treatment, crisis response, or emergency services through our website, events, content, sessions, or communications unless explicitly stated in writing by a licensed provider acting within a separate professional relationship.

Nothing on our website, in our content, or in our offers should be interpreted as medical advice, mental health treatment, diagnosis, or a substitute for licensed professional care.

If you are experiencing a medical or mental health emergency, call 911 or seek immediate help from an appropriate licensed professional or emergency service provider.
5 Participation Responsibility

You are responsible for your own decisions, actions, health choices, and participation. By registering for or participating in any offer, you acknowledge that:

  • You are participating voluntarily
  • You are responsible for determining whether an offer is appropriate for you
  • You are responsible for reviewing any preparation instructions, contraindications, or participation guidance provided to you
  • You are responsible for seeking medical or mental health advice where appropriate
  • You will stop participation and seek appropriate help if you experience distress or concerns beyond what feels safe or appropriate for you

For offers involving breathwork, embodiment, nervous system work, or in-person experiences, you understand that your participation is subject to any separate waiver, release, intake review, or participation policy that may apply.

6 No Guarantees or Promises of Results

We make no guarantees, warranties, or promises regarding any specific outcome, financial result, emotional result, healing result, business result, personal transformation, or other benefit from using our website, purchasing our products, or participating in our services.

Individual experiences vary. Testimonials, stories, or examples shared on our website, in marketing, or by participants are illustrative only and are not guarantees that you will experience the same or similar results.

7 Purchases and Payment

By making a purchase, you agree to provide current, complete, and accurate purchase and payment information. You agree that:

  • All charges are authorized by you
  • You are responsible for the full amount of your purchase
  • You will not use payment methods you are not authorized to use
  • You remain responsible for any taxes, fees, or charges associated with your purchase unless otherwise stated

We reserve the right to refuse, limit, cancel, or decline any order, booking, registration, or transaction at our discretion, including where we suspect fraud, misuse, unauthorized activity, pricing errors, technical errors, or policy violations.

8 Pricing Errors and Corrections

We make reasonable efforts to display accurate pricing and offer details. However, we reserve the right to correct errors, inaccuracies, omissions, or outdated information at any time, including after an order is submitted.

If a pricing or offer error materially affects your purchase, we may cancel the transaction and notify you, or provide you the option to proceed under corrected terms where appropriate.

9 Refunds, Cancellations, Transfers, and No-Shows

Refund, cancellation, transfer, rescheduling, and no-show rules may vary by offer. Those rules may be stated on the checkout page, sales page, registration page, event page, booking confirmation, or in a separate refund or cancellation policy. By purchasing or registering, you agree to the policy applicable to that specific offer.

Unless otherwise stated in writing:

  • Purchases are binding once made
  • Missed sessions, missed events, or failure to use purchased access does not automatically create a right to a refund
  • We are not responsible for participant scheduling conflicts, travel issues, internet issues, forgotten attendance, or failure to review event details
  • Transfer or reschedule requests may be granted or denied at our discretion unless a specific policy states otherwise

If an offer includes installment payments, you remain responsible for completing all payments according to the agreed schedule unless a written policy states otherwise.

10 Memberships and Recurring Billing

If you join a membership, subscription, or recurring payment offer, you authorize us or our third-party payment processor to charge the payment method on file according to the recurring billing terms presented at the time of purchase. Unless a specific offer states otherwise:

  • Memberships continue until cancelled according to the applicable cancellation terms
  • Cancellation stops future billing only and does not automatically create a refund for past charges
  • Access may continue through the remainder of the current billing period, unless otherwise stated
  • Failed or declined payments may result in suspended or terminated access

We reserve the right to change membership pricing, features, or structure with reasonable notice where appropriate.

11 Digital Products and Immediate Access

For digital products, downloadable materials, recordings, courses, memberships, or other instantly accessible content, access may begin immediately upon purchase.

Because of that immediate access, refunds may be limited or unavailable once access has been granted, unless a specific written policy for that offer states otherwise.

You are responsible for ensuring that you have the internet access, software, device compatibility, and technical ability needed to use digital content.

12 Events, Sessions, and Scheduling

We reserve the right to modify, reschedule, relocate, substitute, postpone, or cancel events, classes, sessions, or offerings where reasonably necessary due to safety, illness, venue issues, low enrollment, technical issues, force majeure events, or other circumstances beyond our reasonable control.

If we cancel an offer and do not provide a rescheduled date or reasonable substitute, we may provide a refund, credit, or transfer option at our discretion or as required by the applicable offer terms.

You are responsible for arriving on time, following instructions, and complying with participation rules for in-person and online events.

13 Right to Refuse Service or Remove Participation

We reserve the right to refuse service, deny access, remove participation, cancel registration, or terminate access at our discretion if we determine that a person:

  • Violates these Terms or any applicable policy
  • Is abusive, threatening, harassing, or disruptive
  • Engages in unsafe behavior
  • Appears to be participating in bad faith
  • Infringes intellectual property rights or misuses content or access
  • Poses a risk to the safety, wellbeing, privacy, or experience of others
  • Has provided materially false information
  • Engages in chargeback abuse or fraudulent conduct

If access is terminated for policy, safety, abuse, or misuse reasons, we are not obligated to provide a refund unless required by law or a written policy applicable to that offer.

14 Intellectual Property

All content made available by Wild Gems Collective is owned by or licensed to us and is protected by applicable intellectual property laws. This includes, without limitation: website copy, branding, graphics, logos, course materials, handouts, workshop materials, videos, audio, meditations, class content, downloads, written content, frameworks, designs, training materials, and event materials.

Your purchase or participation grants you a limited, non-exclusive, non-transferable, revocable license for your own personal, non-commercial use only, unless we expressly state otherwise in writing.

You may not, without prior written permission:

  • Copy, reproduce, republish, or distribute our content
  • Modify, adapt, translate, or create derivative works from our content
  • Share purchased materials with others or upload or resell our materials
  • Use our materials to create competing offers
  • Remove copyright, trademark, or proprietary notices
  • Record or redistribute sessions where recording is not expressly permitted
15 User Accounts, Access, and Credential Sharing

If any offer includes account access, login credentials, membership portals, or protected content, you are responsible for maintaining the confidentiality of your access credentials.

You may not share your login, give others access to your purchased materials, or permit multiple users to access a single-user offer unless the offer expressly allows that.

We reserve the right to suspend or terminate access if we believe account sharing, misuse, unauthorized access, or security violations have occurred.

16 Community Standards and User Conduct

If an offer includes a community space, live group setting, comments, chat, or participant interaction, you agree to engage respectfully and lawfully. You may not:

  • Harass, intimidate, threaten, or abuse others
  • Post unlawful, defamatory, obscene, discriminatory, or hateful content
  • Give medical or mental health advice while presenting yourself as qualified when you are not
  • Solicit others without permission or spam, disrupt, or interfere with community operations
  • Invade the privacy of other participants or share private participant information outside the group
  • Record other participants without permission

We reserve the right to moderate, remove, restrict, or terminate access to community spaces at our discretion.

17 Confidentiality and Respect for Others

You agree to respect the privacy and confidentiality of other participants, customers, members, and attendees.

Wild Gems Collective cannot guarantee that all participants will maintain confidentiality, especially in group settings, but we expect respectful conduct and reserve the right to remove participants who violate privacy expectations or community rules.

You agree not to share, publish, or exploit private participant disclosures, names, images, stories, or identifying details obtained through our offers without permission.

18 Testimonials, Feedback, and Submissions

If you voluntarily provide testimonials, reviews, suggestions, comments, photos, videos, or feedback, you grant us permission to use, reproduce, publish, adapt, and display that content for business, promotional, educational, or marketing purposes, unless we expressly agree otherwise in writing.

You represent that you have the right to submit that content and that it does not infringe the rights of any third party.

If you want a testimonial or submission removed, you may contact us, and we will review the request, but we do not guarantee removal in every context where use was authorized.

19 Electronic Communications and Electronic Acceptance

By using our website, submitting forms, purchasing, registering, or clicking to accept terms, you consent to receive electronic communications related to your transaction, access, participation, or account.

To the extent permitted by law, you agree that electronic records, acknowledgments, and acceptances may satisfy legal requirements for writings and signatures.

U.S. federal law generally recognizes the legal effect of electronic records and signatures and also makes clear that consumers cannot be forced to accept them without the required consent framework.
20 Privacy

Your use of our website and services is also subject to our Privacy Policy. Our Privacy Policy explains how we collect, use, and handle personal information.

By using our website or services, you acknowledge that you have reviewed our Privacy Policy.

21 Third-Party Tools, Platforms, and Links

We may use or link to third-party platforms, processors, software, services, tools, or websites in connection with our offers. Those third-party providers have their own terms and privacy practices that govern your use of their services.

We are not responsible for the content, practices, availability, or accuracy of third-party platforms or services. Links to third-party sites do not constitute our endorsement of those sites.

22 Disclaimer of Warranties

Our website, content, and services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, to the fullest extent permitted by law.

We do not warrant that our website will be uninterrupted, error-free, secure, or free of viruses. We do not warrant that any particular result will be achieved from use of our services.

23 Limitation of Liability

To the fullest extent permitted by applicable law, Wild Gems Collective and its owners, members, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, emotional distress, or damages arising from your use of or inability to use our website or services.

Our total liability for any claim arising out of or relating to these Terms or our services shall not exceed the amount you paid to us in the three months preceding the claim, or $100, whichever is greater, to the extent permitted by applicable law.

Idaho consumer protection law still applies regardless of contractual limitation clauses, which is why we cannot simply disclaim all liability here.
24 Indemnification

You agree to indemnify and hold harmless Wild Gems Collective and its owners, members, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of our website or services, your violation of these Terms, your violation of any applicable law, or your conduct in connection with any offer.

25 Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Idaho, without regard to conflict of law principles.

Any dispute arising under or related to these Terms shall first be addressed through good faith negotiation. If the dispute cannot be resolved informally, it may be submitted to binding arbitration or small claims court in Ada County, Idaho, as appropriate, unless applicable law requires otherwise.

26 Severability

If any provision of these Terms is found to be invalid, unenforceable, or contrary to applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall remain in full force and effect.

27 Entire Agreement

These Terms, together with any applicable offer-specific policies, constitute the entire agreement between you and Wild Gems Collective with respect to your use of our website and services, and supersede all prior or contemporaneous agreements, representations, or understandings.

28 Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we do, we will update the "Last Updated" date at the top of this page. Your continued use of our website or services after changes are posted constitutes your acceptance of the revised Terms.

If changes are material, we may provide additional notice where appropriate.
