9D Breathwork Waiver, Release of Liability,
Medical Disclaimer, and Informed Consent

I understand that participation in 9D Breathwork is fully voluntary.

I understand that I am choosing to participate in a breathwork experience that may involve deep breathing patterns, music, guided prompts, emotional release, physical sensations, mental and emotional processing, nervous system activation, altered perception, and intense internal experiences.

I understand that I may stop or pause my participation at any time and that I am responsible for communicating if I need assistance, a break, a modification, or discontinuation.

I understand that 9D Breathwork is a guided wellness and personal growth experience. It may involve physical, emotional, energetic, psychological, and spiritual elements depending on the participant's personal experience.

I understand that experiences vary from person to person.

I understand that possible effects during or after a session may include, but are not limited to:

• Dizziness, tingling, or lightheadedness
• Muscle tension or cramping
• Shaking or trembling
• Emotional release, crying, or laughter
• Fatigue or heightened sensitivity
• Temporary anxiety or disorientation
• Vivid dreams or emotional discomfort
• Temporary physical discomfort
• Feelings of euphoria, grief, anger, sadness, or relief

I understand that some effects may continue for a period of time after the session.

I understand that Wild Gems Collective and its facilitators, contractors, team members, and representatives are not providing medical treatment, psychotherapy, psychiatric care, crisis services, or emergency services through 9D Breathwork sessions unless explicitly stated in writing by a separately licensed professional acting in that scope.

I understand that 9D Breathwork is not intended to diagnose, treat, cure, or prevent any disease, medical condition, or mental health disorder.

I understand that no statement made in connection with these services should be interpreted as medical advice, psychological treatment, or a substitute for care from a licensed healthcare provider.

I understand that I am solely responsible for deciding whether participation is appropriate for me.

I agree that I will consult with my physician, mental health provider, or other licensed healthcare professional before participating if I have any question about whether this experience is safe or appropriate for me.

I understand that conditions requiring caution, medical review, or possible non-participation may include, but are not limited to:

• Cardiovascular disease or history of heart problems
• Uncontrolled high blood pressure
• Seizures or epilepsy
• Aneurysm history or stroke history
• Serious respiratory conditions or severe unmanaged asthma
• Recent surgery or major physical injuries
• Detached retina, glaucoma, or serious eye conditions affected by pressure changes
• Pregnancy, especially high-risk pregnancy
• Severe psychiatric conditions, bipolar disorder, schizophrenia, or psychosis
• Dissociative conditions or PTSD triggers not adequately supported
• Panic disorder or recent hospitalization for mental health concerns
• Current substance intoxication

I understand that this list is not exhaustive. I agree to disclose, truthfully and fully, any relevant condition, concern, limitation, medication, pregnancy status, recent injury, or other participation-related issue requested by Wild Gems Collective before the session.

I understand that Wild Gems Collective may ask screening questions or request additional information before allowing me to participate.

I understand that Wild Gems Collective reserves the right to deny participation, require medical clearance, modify participation, stop a session, or refuse future participation if there is concern about safety, contraindications, incomplete disclosure, or inability to participate appropriately.

I understand that this right exists for my protection, for the protection of others, and for the overall safety of the session environment.

I understand that participation in 9D Breathwork involves inherent and potential risks, both known and unknown, foreseeable and unforeseeable.

I knowingly and voluntarily assume all risks associated with participation, including but not limited to:

• Physical discomfort or emotional distress
• Aggravation of a known or unknown condition
• Mental or emotional overwhelm
• Dizziness or faintness
• Injury from movement, falling, or positional changes
• Adverse reactions related to disclosed or undisclosed conditions
• Delayed emotional processing after the session
• Risks related to the venue or online environment
• Risks arising from my own health history, participation choices, or failure to disclose relevant information

To the fullest extent permitted by law, I release, waive, discharge, and hold harmless Huckleberry Gems LLC d/b/a Wild Gems Collective, and its owners, members, managers, employees, contractors, facilitators, volunteers, agents, representatives, affiliates, successors, assigns, venues, and related parties ("Released Parties") from any and all claims, demands, causes of action, liabilities, damages, losses, costs, or expenses arising out of or related to my participation in any 9D Breathwork session, class, event, or related activity.

This release includes, without limitation, claims arising from personal injury, emotional distress, mental anguish, medical issues, aggravation of pre-existing conditions, property damage, economic loss, and negligence to the fullest extent waivable under applicable law.

I understand and agree that this release is intended to be as broad and inclusive as permitted by applicable law.

I agree to indemnify and hold harmless the Released Parties from and against any claims, liabilities, damages, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

• My acts or omissions
• My failure to disclose relevant health or safety information
• My violation of instructions or policies
• My conduct at an event or session
• Claims brought by third parties arising from my participation or behavior

I understand that Wild Gems Collective is not providing medical monitoring or emergency medical care.

If an emergency arises, I authorize Wild Gems Collective to seek emergency assistance on my behalf if deemed reasonably necessary. I understand that emergency response may be delayed or unavailable, Wild Gems Collective is not obligated to provide medical treatment, I remain financially responsible for any medical care I receive, and Wild Gems Collective is not responsible for outcomes related to emergency services, transportation, or outside medical providers.

If emergency contact information is requested, I agree to provide it accurately.

If I participate online, I understand that I am responsible for creating a safe environment for my own participation. Before the session I agree to:

• Choose a private and reasonably safe location
• Avoid driving or operating machinery during the session
• Use a stable internet connection if possible
• Set up a space where I can lie down or sit safely
• Avoid participation in water, while walking, or in any unsafe environment
• Arrange support for myself if I believe I may need it afterward

I understand that online participation may carry additional risks because the facilitator is not physically present with me.

If I participate in person, I agree to follow all venue rules, session instructions, setup guidance, and safety directions.

I agree not to attend if I am intoxicated, aggressive or disruptive, unwilling to follow instructions, or experiencing a condition that makes participation unsafe for me or others.

I understand that I may be asked to leave or stop participating if my behavior creates a safety issue or materially disrupts the session.

I understand that Wild Gems Collective has made no guarantee, promise, or warranty regarding any particular result from participation.

I understand that participant stories, testimonials, or descriptions of transformation are individual experiences only and are not guarantees of my outcome.

Wild Gems Collective will make reasonable efforts to maintain professionalism and privacy in how participant information is handled, consistent with its Privacy Policy.

I understand that group settings are not confidential therapy environments, other participants may hear or observe my participation, Wild Gems Collective cannot guarantee that other participants will keep information confidential, and online platforms may carry technology or privacy limitations beyond Wild Gems Collective's direct control.

I agree to respect the privacy of other participants and not share their personal disclosures without permission.

I understand that sessions may have separate rules regarding photography, video, audio recording, or testimonials.

Unless I give separate written permission, Wild Gems Collective may not use my name, image, voice, testimonial, or likeness for promotional purposes beyond ordinary operational needs.

If I provide a testimonial, review, or post-session feedback voluntarily, I understand it may be used according to any permission I separately grant. If recording is prohibited for a session, I agree not to record it.

I understand that purchasing a session does not guarantee that I will ultimately be permitted to participate if safety or contraindication concerns arise.

Refund, transfer, rescheduling, or credit decisions are governed by the applicable offer terms, cancellation policy, or event policy. Wild Gems Collective reserves the right to remove or deny participation if necessary for safety, policy, or conduct reasons.

I certify that the information I provide to Wild Gems Collective is true, complete, and not misleading to the best of my knowledge.

I understand that failure to disclose relevant physical, mental, emotional, or medical information may increase risk to me and others and may affect my ability to participate.

I accept full responsibility for any consequences arising from withheld, incomplete, or inaccurate information I provide.

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect to the fullest extent permitted by law.

This Agreement shall be governed by and interpreted in accordance with the laws of the State of Idaho, without regard to conflict of law principles.

I understand that by checking a box, clicking "I agree," signing electronically, or otherwise submitting this Agreement, I am providing my legal acknowledgment and consent to these terms.
